1.1 Voghion and its affiliates (collectively or individually, “Voghion,” “we,” or “us”) take your privacy seriously.
Depending on your location and the services you use, the Voghion entity responsible for controlling and processing your personal data will be the relevant Voghion operating entity, acting in accordance with applicable data protection and privacy laws, including those applicable in Australia.

1.2 Where applicable, this Privacy Policy should be read together with any country-specific notices or supplements applicable to your jurisdiction, as set out elsewhere in this Privacy Policy.

1.3 In the course of your use of Voghion’s applications and websites (including both web and mobile versions), as well as the products, information, features, and other services operated by Voghion, we may collect, use, disclose, store, and/or otherwise process data, including your personal data.
For the purposes of this Privacy Policy, “Platform” refers to all relevant applications and websites (both web and mobile versions), and “Services” refers to all products, information, features, and services provided by Voghion from time to time through the Platform.

1.4 This Privacy Policy is intended to inform you about how we collect, use, disclose, store, and/or process data that we collect or receive in the course of providing the Services or granting you access to the Platform, whether or not you have registered for an account as a buyer or a seller. We will only collect, use, disclose, store, and/or process your personal data in accordance with this Privacy Policy.

1.5 It is important that you read this Privacy Policy together with any other applicable notices or policies that we may provide in specific circumstances when collecting, using, disclosing, and/or processing your personal data, so that you are fully aware of how and why your personal data is being used.

1.8 These terms apply to all Voghion users, whether or not they have created an account as buyers and/or sellers, unless expressly stated otherwise.


2. The Personal Information We Collect From You

2.1 We collect the personal information described below in accordance with applicable laws and regulations, and where required, with your consent.

2.2 For the purposes of this Privacy Policy, personal information means any information or opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether recorded in a material form or not.

2.3 Depending on your use of the Platform and/or your interaction with our Services (for example, when you register for an account, log in to the Platform, or transact through the Services), you may be asked to provide certain information. While you may choose not to provide some information, this may limit your ability to access or use certain features or Services on the Platform.
The personal information that you may choose to provide to us includes, where applicable:

(a) Identity and Profile Information, which may include your name, date of birth, gender, username and password, email address, telephone number, interests, and any personal information contained in photographs, videos, or audio recordings that you upload to the Platform.
If you are a seller, this may also include your business or company name, registered address, date of incorporation, and other relevant business-related information (such as company registration details, business licences, tax-related information, and details of directors or authorised representatives), where applicable.

(b) Account and Transaction Information, which may include payment details, bank account information, billing and delivery addresses, transaction records, payments made to or received from you, orders placed or fulfilled through the Platform, and other details relating to products or services bought or sold via the Platform.

(c) Usage Information, such as information about how and when you access or use the Platform, products, or Services, the content you view, interaction data, and information about websites or applications you visited prior to accessing the Platform.

(d) Marketing and Communications Information, which may include your marketing preferences, survey responses, communication preferences, feedback, and records of communications with us or with third-party service providers through the Platform, including chat, email, or call history.

(e) Location Information, such as information derived from your device or provided by you when you check for services available near you or track the delivery or collection status of orders.

(e) when you place, process, or complete transactions involving products or services available on the Platform;
(f) when you activate or use any payment-related features on the Platform or provided by our third-party service providers;
(g) when you use any features, tools, functions, mini-applications, or interactive content available on the Platform or through the Services;
(h) when you create, upload, or record user-generated content on the Platform;
(i) when you use messaging, chat, or communication functions available on the Platform;
(j) when you subscribe to newsletters, updates, or marketing communications;
(k) when you participate in competitions, promotions, surveys, or similar activities;

2.7 Where permitted by applicable laws, you acknowledge and agree that you have provided any necessary consent (whether to us, to a third party, or to our affiliates) for the transfer of your personal information from third parties and/or affiliates to Voghion for the purposes described in this Privacy Policy and any other applicable terms.

2.8 You agree to ensure that any personal information you provide is accurate, complete, and not misleading, and to keep such information up to date. We may request reasonable documentation or conduct verification checks where necessary for account verification, compliance, security, or as required by applicable laws.

2.9 Certain categories of personal information may only be collected if you voluntarily provide such information or as otherwise permitted under this Privacy Policy. If you choose not to provide personal information or withdraw your consent, we may be unable to provide certain features, functionality, or access to the Platform or Services.

2.10 In some circumstances, you may provide us with personal information relating to other individuals (for example, when adding contacts, recipients, or beneficiaries, or using social or referral features). You represent and warrant that you have obtained all necessary consents, permissions, or authorisations from those individuals for the collection, use, disclosure, and processing of their personal information in accordance with this Privacy Policy.

2.11 If you choose to register for or access the Platform using a third-party account (such as a social media or external authentication service), or link your Voghion account to such services, we may receive personal information that you have authorised the relevant third party to share with us, in accordance with that third party’s policies. We will handle such personal information in accordance with this Privacy Policy.

Collection of Computer Data

2.12 Voghion and/or its authorised service providers may use cookies, web beacons, pixels, and other similar technologies in connection with your use of the Services or access to the Platform.

2.13 When you access or use the Platform through a computer, mobile device, or any other internet-enabled device, our servers may automatically record certain information sent by your browser or device, including technical and usage information such as device identifiers, browser type, operating system, access times, pages viewed, and interaction data.

2.14 This information is collected for purposes including analysis and evaluation, to help us improve the Platform, Services, and the products we offer, to personalise content and user experience, and to make the Platform and Services more efficient, convenient, and relevant to you.
Where permitted by applicable laws, such information may also be used to deliver more relevant advertising, promotions, or recommendations relating to products, services, or features available on or through the Platform.

2.15 Cookies are small text files (typically consisting of letters and numbers) that are stored on your browser or device when you visit a website or access online content. Cookies enable us to recognise your device or browser and remember certain information.
Web beacons (also known as pixels or tags) are small graphic images that may be embedded in the Platform or Services. They allow us to understand user behaviour, such as whether content has been viewed, and help us improve our services and user experience.

Purpose of Use

3.1 We use and disclose personal information for the purposes described below in accordance with applicable laws and regulations, and where required, with your consent.

3.2 Depending on your relationship with us (for example, whether you are a buyer, seller, visitor to our websites, or a user of our mobile applications), the personal information we collect from you directly or through third parties may be used for purposes including, but not limited to, the following:

(a) To provide access to the Platform and Services, and to facilitate your use of the Platform.

(b) To administer and manage your account, including account registration, authentication, and maintenance.

• conduct marketing, promotional, or advertising activities; and
• use user-generated content that you choose to share on the Platform for promotional purposes, subject to applicable laws and platform policies.

(iv) Other purposes, including to:
• better understand and improve our buyer services; and
• conduct automated decision-making processes related to the above purposes, in compliance with applicable laws and consent requirements.

3.4 If you are a seller, personal information collected from you or via third parties may also be used for the following purposes:

(i) Providing seller-related Services, including to:
• facilitate shipping or delivery of products you list or sell, including sharing information with logistics partners, affiliates, or regulatory authorities where required;
• respond to seller enquiries, feedback, claims, or disputes;
• verify documentation and information provided during seller onboarding or ongoing compliance processes;
• display your seller profile or business information on the Platform;
• verify and process financial transactions, including payments, settlements, and promotions, through payment service providers;
• assess eligibility for seller financing, credit, insurance, or related services where applicable;
• provide logistics-related services to manage delivery risks or returns; and
• facilitate product returns to sellers.

(ii) Marketing and advertising, including to:
• provide sellers with marketing, promotional, or informational materials relating to the Platform or available services; and
• support marketing and promotional activities.

 

(iii) Other purposes, including to:
• better understand and support our seller community; and
• conduct automated decision-making processes in connection with these purposes, in compliance with applicable laws and consent requirements.

Who We Disclose Your Personal Information To

3.5 We may share, disclose, or permit access to your personal information with third parties and/or our affiliates, and may transfer such personal information within or outside your jurisdiction, where necessary for the purposes described above and in accordance with applicable laws.
These third parties and affiliates may include, but are not limited to:

(i) Service providers and partners, such as agents, vendors, contractors, and other third parties that provide services relating to payment processing, logistics and shipping, marketing, advertising, data analytics, market or consumer research, surveys, social media, customer support, installation or fulfilment services, information technology, cloud services, and website hosting;

(iv) Other users of the Platform or Services, where such disclosure is necessary to facilitate transactions, communications, reviews, or other interactions available through the Platform.

3.6 When disclosing personal information to third parties or affiliates, we take reasonable steps to ensure that such parties handle your personal information securely and in accordance with applicable data protection and privacy laws. We also seek to ensure that personal information is retained only for as long as necessary to fulfil the purposes for which it was disclosed, unless a longer retention period is required or permitted by law.

International Data Transfer

3.7 Voghion may transfer, or permit the transfer of, your personal information to recipients located outside your jurisdiction for any of the purposes described in this Privacy Policy. Such transfers may occur to countries where we, our affiliates, or our service providers operate. We will take reasonable steps to ensure that any overseas transfer of personal information is carried out in accordance with applicable data protection and privacy laws, including by implementing appropriate safeguards. Third Party Services

3.8 Voghion may share your personal information with third-party service providers or affiliates (for example, payment service providers) to enable them to provide services to you in connection with your use of the Platform or the Services. 8.1 Voghion will retain your personal information only for as long as it is necessary to fulfil the purposes for which it was collected, or as otherwise required or permitted by applicable laws and regulations.
8.2 Where personal information is no longer required for the purposes for which it was collected, and is no longer necessary for any legal, regulatory, or business purpose, we will take reasonable steps to cease retaining such personal information. This may include securely deleting or destroying the information, or anonymising it so that it can no longer be associated with you.

9. Minors

9.1 Voghion does not knowingly offer products or Services to minors (as defined under applicable laws), nor does it intend to provide access to the Platform to minors. We do not knowingly collect personal information relating to minors.

9.2 By accessing or using the Platform or Services, you represent and warrant that you have reached the age of majority in your jurisdiction and that you are capable of understanding and accepting the terms of this Privacy Policy. If you are a minor, you may only use the Platform with the involvement and consent of a parent or legal guardian.

9.3 If you are a parent or legal guardian, you should not permit a minor under your care to submit personal information to Voghion without your consent. 10.2 Please note that even where a third party is affiliated with Voghion, we do not control third-party websites or services, each of which may have its own independent privacy and data collection practices. Accordingly, Voghion is not responsible or liable for the content, security measures (or lack thereof), or activities of any linked third-party sites or services. Such links are provided solely for your convenience, and you access them at your own risk. Nevertheless, we seek to protect the integrity of the Platform and welcome feedback regarding any third-party links, including if a link is not functioning correctly.
